By accessing or using Serverlys services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These Terms of Service apply to all visitors, users, and others who access or use our services.

We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the services following the posting of any changes constitutes acceptance of those changes.

Services Description

Serverlys provides web hosting, cloud hosting, domain registration, managed WordPress hosting, ecommerce hosting, and related internet infrastructure services. We offer shared hosting, VPS hosting, dedicated servers, and cloud solutions designed to meet a variety of business and personal needs.

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of services.

Account Registration

To use certain features of our services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password you use to access the services and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Payment & Billing

All fees are quoted in US Dollars unless otherwise stated. You agree to pay all fees associated with your account. Fees are non-refundable except as expressly stated in our refund policy or as required by applicable law.

• Billing cycles begin on the date of purchase and renew automatically.
• We accept major credit cards, PayPal, and other payment methods as displayed at checkout.
• Promotional pricing applies to the initial term only; renewals are at standard rates.
• Late or failed payments may result in service suspension or termination.

Acceptable Use Policy

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include but are not limited to:

• Distributing spam, malware, or phishing content
• Hosting illegal content or facilitating illegal activities
• Attempting to gain unauthorized access to other systems or networks
• Cryptocurrency mining without explicit written permission
• Excessive use of server resources that impacts other users

Service Level Agreement

Serverlys guarantees 99.9% uptime for all hosting services. This SLA excludes scheduled maintenance windows, force majeure events, and issues caused by customer actions or third-party services.

In the event of a verified SLA breach, affected customers may be eligible for service credits. Credits must be requested within 30 days of the incident and are limited to the monthly fee for the affected service.

Intellectual Property

The Serverlys name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Serverlys LLC. You retain all rights to the content you upload to our services. By using our platform, you grant Serverlys a limited license to host and display your content solely for the purpose of providing our services.

Limitation of Liability

To the maximum extent permitted by law, Serverlys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

Our total liability for all claims related to our services shall not exceed the amount you paid to Serverlys in the twelve (12) months preceding the claim.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. Upon termination, your right to use the services will immediately cease. You may request a copy of your data within 30 days of termination, after which we may delete all associated data.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in Delaware.
